Rules, Regulations & Guidance

Under state statute 19 TAC 89.1001(a), special education services shall be provided to eligible students in accordance with all applicable federal laws and regulations, state statutes, rules of the State Board of Education (SBOE) and commissioner of education, and the State Plan Under Part B of the Individuals with Disabilities Education Act (IDEA).

Child Find

Child Find is a district responsibility that is a component of the Individuals with Disabilities Education Act (IDEA 2004) that requires schools to identify, locate, and evaluate all children with disabilities residing within the State, regardless of the severity of their disabilities, and who are in need of special education and related services (34 CFR 300.111).
Child Find is a continuous process of public awareness activities, screening, and evaluation designed to locate, identify, and evaluate children who are in need of Early Childhood Intervention (ECI) Programs or Special Education.

Residential Facilities Monitoring

Under the consent decree in the case of Angel G. et al. v. Texas Education Agency et al., otherwise known as the Angel G. case, the TEA is required to implement a separate system for monitoring those LEAs that serve students with disabilities who reside in residential facilities (RF) within the geographic boundaries and/or jurisdiction of the LEA. This separate system functions independently from the present monitoring system and applies directly to those LEAs that provide special education and related services to students with disabilities residing in RFs.
